Disputes

Any dispute relating in any way to your visit to InsultingGifts.com or to products you purchase through InsultingGifts.com shall be submitted to confidential arbitration in Lawrence, Kansas, except that, to the extent you have in any manner violated or threatened to violate InsultingGifts.com's intellectual property rights, InsultingGifts.com may seek injunctive or other appropriate relief in any state or federal court in the state of Kansas, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Malicious Intent

There are several reasons to send an insulting gift to someone. Maybe it’s your best friend, maybe it’s your worst enemy – it makes no difference to us. However, what we do not condone under any circumstances is to send someone an insulting gift to harass or with the intent to cause fear within the recipient. These gifts are meant to be funny and insulting, no more. If we suspect misuse of our services we will, at our sole discretion, withhold shipment of our items. Play nice…
